The parents of a Desert Hills High School student killed while handling a pistol for the school play have officially filed a lawsuit.
Ron and Cathie Thayer say their attorney filed a wrongful death and negligence suit Thursday in the U.S District Court.
The Thayers believe the litigation and death of their son, Tucker is not just a small town accident
You may remember, a gun's blank shot struck 15 year old Tucker Thayer in the head hours before the school's performance of Oklahoma back in November. The boy died later that night.
The Thayer family says after seven and half months of unanswered question, it's time to talk about responsibility.
Court documents name the Washington County School District, St. George Police and the gun's owner in the suit.
The letter of intent also includes the high school resource officer, theater teacher and assistant principal.
The Thayers say adult supervision and responsibility needed to come into play in this situation...and because it didn't a tragedy occurred.
And while the family knows they may be facing a long drawn out legal process, they say they are prepared and ready for Tucker's sake.
As of right now, the police department and school district have declined to comment on the pending legal matters.
